Introduction
This document explains your right to privacy when viewing and/or interacting with the Mallard Computer website, mallardcomputer.com, My Mallard, mymallard.com, My Mallard Community, and/or other websites affiliated with Mallard, using Mallard services, and/or electronic communications between you and Mallard. For more information about your right to privacy, please see the Additional Information section of this document, or simply contact us.

Personal Information
During normal browsing of any Mallard affiliated website, Mallard does not in any way collect personal information from you. The only time personal information is collected from you is when:
  • You fill out an online submission form
  • You send electronic communication to Mallard
  • You post a comment to one of Mallard’s blogs, communities, forums, etc.
  • You place an order for a product and/or service
  • You register and/or activate a product and/or service
  • You create and/or log into a My Mallard account

Cookies
During normal browsing of any affiliated Mallard website, cookies are not placed onto your system directly by Mallard. The only time cookies may be placed onto your system is when:
  • You decide to save your contact information and/or My Mallard ID and/or password for easy login
  • You enter some kind of personal information and check mark a “save” box to allow the information to be cached
  • The web hosting provider chosen by Mallard decides to place cookies onto your system for their purposes

Use of Personal Information
When personal information is used, it will only be used in the following situations:
  • For submission of an order and/or service request
  • For shipping of a physical product
  • For electronic delivery of a digital (downloadable) product
  • For registration and/or activation of a product and/or service
  • For account informational purposes
  • For electronic communication between Mallard and you
  • For internal market research purposes
We will never share, sell, rent, or distribute personal information to anyone not affiliated with Mallard unless it has been ordered by a court of law.

Public Information
When posting information to public sections of the Mallard website, such as blogs, communities, and/or forums, please be aware that the information you post is viewable by everyone and cannot be made private. Please keep this in mind to ensure that the information you post is information you are comfortable with the public viewing.

Children
Mallard recognizes that children are a valuable and precious resource to this community and particularly strives to ensure the privacy of children using our services remains protected. All children under the age of 13 must be accompanied by a guardian before submitting any personal information to Mallard. Any violations to this agreement will be promptly put into a pending state until the guardian sends us a written consent form to proceed with the collection of the information. If this consent is not presented to us within 30 days of submission, the information will then be deleted.

Online Purchases
Online purchases and/or transactions made through Mallard are secured using all of the latest security standards. These include, but are not limited to: SSL, https://, use of a My Mallard ID and password to purchase, PayPal, and server level firewall and malware protection. Over the phone, Mallard Store, Mallard Store in a Store, authorized Mallard retailer, and mail-order purchases are subject to physical security methods.

Additional Information
Mallard hosts its website and communities on various web services including, but not limited to: MobileMe, NING, Flickr, YouTube, Facebook, LnkedIN, and Zoho. When browsing different Mallard-based sites, not only does Mallard's Privacy Policy apply as your right to privacy, but privacy policies of the various web services we use serve as your right to privacy as well. In the event there becomes a discrepancy in the web service's Privacy Policy and Mallard's Privacy Policy, we will strive to enforce our Privacy Policy, with the web service provider enforcing theirs, where controllable by law. You will agree to be bound by both agreements and to indemnify, defend, and hold harmless Mallard Computer, Inc., its affiliates, agents, employees and licensors from and against any and all claims and expenses, including reasonable attorney fees, arising out of or related in any way to your use of the site, violation of this Agreement, violation of any law or regulation, or violation of any proprietary or privacy right.

Modifications to Agreement
This agreement may be modified and/or amended at anytime without any additional notification to you that modifications have been made. It is your responsibility to periodically check this document to ensure you understand the modifications that have been made provide adequate protection of your right to privacy. If you feel that your right to privacy is not adequately documented in this agreement, you may either contact Mallard in writing stating what you wish to see amended and/or modified or discontinue use of Mallard services immediately.
